Background and Global Context

The right to be forgotten, popularly known as "right to erasure," is one of the landmark provisions under European information privacy regulations. The court established this provision after the case concerning Mario Costeja González, a Spanish lawyer, who had demanded Google to pull down old and irrelevant information, relating to him, from the search results. The court specifically made reference to Articles 7 and 8 of the EU Charter on Fundamental Rights, pronouncing particularly on the right to respect for private and family life as well as the right to the protection of personal data.

The Indian Scenario

In India, the right to be forgotten does not enjoy explicit statutory backing. However, the right to privacy was declared a fundamental right through the judgment delivered by the Supreme Court in 2017 in the case of Justice K S Puttaswamy v Union of India. Justice S K Kaul, in his opinion concurring with the majority, stated that the right to be forgotten must provide a right to the people to delink, disassociate, and dissociate from themselves personal information whose use has ceased to be necessary, relevant, or has lost its quality of being accurate and has no bearing on public interest.

About the Case Before the Supreme Court

A three-judge bench led by Chief Justice of India D Y Chandrachud is going to hear a challenge made to a Madras High Court verdict. That verdict had ordered legal search portal Indian Kanoon to remove a judgment in a 2014 rape and cheating case which involved an acquitted person. The acquitted man's contention was that the judgment continued to be available on the portal and therefore came in the way of his getting Australian citizenship.

What is the Right to be Forgotten?

The right to be forgotten refers to the right to erasure, where an individual could have their information deleted from the public or digital records when it is irrelevant, inefficient, or inaccurate. This relatively new right helps protect the privacy of individuals since they can control their digital footprints. Originating from European Union legislation, it was specifically established in 2014 through the "Google Spain case" by the Court of Justice of the European Union, in which it was held that an individual has the right to require obsolete personal data to be erased from an index of a search engine so that the information is no longer made available in the search results.

Significance of the Right to be Forgotten

The right to be forgotten is significant for several reasons:

  • Protection of Privacy: It enhances personal privacy by allowing a person to delete irrelevant and obsolete personal data, thus reducing opportunities for identity theft or encroachment of reputation.
  • Digital Self-Determination: It gives a person the possibility of independently controlling personal data when acting in the digital space as one of the important conditions for an individual's self-determination.
  • Rehabilitation Support: This helps prevent, for those who have been acquitted of crimes and who have served their sentences, any legacy issues that would hinder their social integration and cooperation in future opportunities.
  • Cultural Relevance: This caters to the progressive culture of privacy rights in this digital age, when information can be accessed and disseminated with greater ease.

Issues Associated with the Right to be Forgotten

Though the right to be forgotten is a powerful instrument for maintaining an individual's privacy, it also suffers from the following:

  • Freedom of Expression: The right to be forgotten raises concern about the fundamental right of freedom of expression and information, specifically when issues of public interest and the freedom of journalism are involved.

  • Potential for Abuse: This could prove quite prone to easy misuse by interested persons even to hide legitimate public interest information, including old criminal records or even instances of professional misconduct.

Previous Landmark cases on the Right to be Forgotten

There have been some landmark cases in the discourse around the right to be forgotten in India:

  • Rajagopal vs. State of Tamil Nadu (1994) - The Supreme Court held the right to privacy and the "right to be let alone," though distinct from the right to erase public records.
  • Dharamraj Bhanushankar Dave vs State Of Gujarat (2017): The Gujarat High Court denied a prayer seeking the expunging of court records from the public domain, highlighting the public interest in the availability of judicial pronouncements.
  • The Registrar General, Karnataka HC (2017) Case: In an annulment petition, the High Court of Karnataka anonymized the petitioner, commenting on the growing recognition of privacy where the nature of the information is sensitive.

Right to Privacy and Right to be Forgotten

The right to be forgotten is an adjunct of the right to privacy. In an important judgement, this right has been recognized as part of the basic structure of the Indian Constitution by the Supreme Court of India in Justice K S Puttaswamy v. Union of India in 2017, which provides the right to privacy including the right to control personal information. As observed, in the Puttaswamy judgment, by Justice S K Kaul, the right to be forgotten allows an individual to control personal data, which may be irrelevant or no longer needed. This meshing of both rights is imperative to ensuring personal autonomy and dignity in the cyber age.

Government Initiatives to Protect Privacy

The Indian government has taken several initiatives to protect privacy, including:

  • Personal Data Protection Bill (PDPB), 2019: A bill suggested in the year 2019 for the objective of putting in place a data protection framework consisting of, among other things, provisions regarding the right to be forgotten.
  • Aadhaar and Other Laws (Amendment) Act, 2019: Incorporates measures for increasing data security and data-privacy measures needed to address concerns emanating from the Aadhaar system.
  • Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021: Amended requirements that will be laid on the intermediaries and digital platforms to protect the data of users and provide privacy.
  • Initiatives in Cybersecurity: Specifically, programs like Computer Emergency Response Team (CERT-IN) tend to work toward making cybersecurity stronger, thereby preventing personal data breaches as well.

  • Develop judicial guidelines on how to balance the right to be forgotten with other fundamental rights, such as freedom of expression and possible public interest considerations.
  • Invest in technological advancements and their provisions, making the removal of data feasible without misuse.
  • Increase public awareness and understanding of digital rights, including the right to the deletion of personal information, to empower individuals to assert their privacy rights.
  • Cooperate with other countries to establish global best practices and ensure enforcement of data protection and privacy rights across the border.
